Moving Traditions (collectively “us” or “we”) is the operator and host of the www.movingtraditions.org website (together with its sub-domains and associated services, including but not limited to, emails from movingtraditions.org and its sub-domains, and social media sites operated by Moving Traditions, the “Site”). Dispute Resolution

IT FURTHER PROVIDES THAT YOU WILL NOT BE ABLE TO BRING A CLASS ACTION OR OTHER REPRESENTATIVE ACTION IN COURT, NOR WILL YOU BE ABLE TO BRING ANY CLAIM IN ARBITRATION AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION. You will bring any claim, dispute, or controversy against Moving Traditions arising from these Terms of Use or your use of the Site or any information you receive from us (each a “Claim”) only through mandatory, binding arbitration as provided in this paragraph. All Claims, other than injunctive relief, are subject to arbitration, no matter what theory they are based on or what remedy they seek. The arbitration will be conducted as an individual arbitration. Neither you nor Moving Traditions consent or agree to any arbitration on a class or representative basis, and the arbitrator shall have no authority to proceed with arbitration on a class or representative basis. No arbitration will be consolidated with any other arbitration proceeding without the consent of all parties. This arbitration provision applies to and includes any Claims made and remedies sought as part of any class action, private attorney general action, or other representative action. American Arbitration Association (“AAA”) will administer the arbitration. The AAA will apply its rules, codes, or procedures in effect at the time the arbitration is filed. The arbitration shall be before a single arbitrator. All fees, including attorneys’ fees, will be allocated in accordance with the AAA rules.
Notice and Procedure for Notifying Designated Agent of Claims of Copyright Infringement
If you believe that any material on the Site infringes upon any copyright which you own or control, or that any link on our Site directs users to another website that contains material that infringes upon any copyright which you own or control, you may file a notification of such infringement with our designated agent as set forth below. Miscellaneous
These Terms of Use constitute the entire agreement between you and us regarding your use of the Site. These Terms of Use will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania without regard to conflicts of law principles. The failure of Moving Traditions to exercise or enforce any right or provision of the Terms of Use will not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action brought against Moving Traditions and its affiliates, service providers, employees, agents, licensors, and partners, arising out of or related to use of the Site or the Terms of Use, must be filed within one year after such claim or cause of action arose or be forever barred.
